The six-month period of voluntary application of the new Technical Building Code has been suspended due to the declaration of a state of alarm, according to a statement issued by the Ministry of Transport, Mobility and Urban Agenda (MOPT).Mitma). The number of days corresponding to the duration of the current situation caused by the Covid-19 health crisis should be applied to this period.
With regard to the works that already had a licence before 14 March 2020, and whose projects were not adapted to Royal Decree 732/2019, the Ministry informs that they must begin within the period foreseen in the licence itself plus the period corresponding to the duration of the state of alarm. If there is no provision, the period corresponding to the state of alarm will be added to the period of six months from the granting of the licence. Otherwise, they must adapt their projects to the modifications of the CTE approved in Royal Decree 732/2019.
On the other hand, those works that have applied for a licence before 14 March 2020 but have not yet obtained it and whose projects have not been adapted to Royal Decree 732/2011, will obtain these licences once the state of alarm has ended, as a result of the suspension of deadlines for administrative procedures in force during this period. These works must begin within the period foreseen in the licence itself. If there is no provision, they must begin within six months of the granting of the licence. Otherwise, they must adapt their projects to the modifications of the CTE approved in Royal Decree 732/2019, concludes the Ministry.
